Terms and Conditions 

1.         Detailed description of services

Umami mountain retreat is a business in the recreational industry that provides nature-based retreats.

 

2.         Service delivery policy

Subject to availability and receipt of payment or deposits as specified, retreat requests will be processed within 7 days and delivery confirmed by way of email confirmation.

 

3.         Refunds and cancellation policy

The provision of retreat services by Umami Mountain Retreat is subject to availability of booking space. Umami Mountain Retreat will provide all retreat guests with a 100% refund when cancellation occurs 6 months prior to the arrival date.

Cancelation Refund terms apply for individual booking contracts:

 

  • Cancelation 30 - 60 days prior to arrival - 100% credit will be given to book another retreat with the option to change guests attending. R200 admin fee will be charged.

  • Less than 30 days before arrival - no refund given.

 

In the case of a guest group booking, if this contract is cancelled or changed for any reason after the contract has been signed, the guest group agrees to pay the following:

  • Cancellation 1 - 30 days prior to the group arrival date, the Guest Group deposit will be forfeited.

  • Cancellation 31 – 60 days prior to the group arrival date, 50% of the deposit will be returned.

 

4. Considerate behavioural conduct while visiting Umami

​

Umami Mountain Retreat is shared with other guests. Retreat Guests undertake to use the Umami Mountain Retreat facilities and grounds in a respectful manner. Retreat Guests agree to be mindful and courteous to all other participants, teachers, and employees present at Umami Mountain Retreat during use of the property and facilities, considering the proximity to others and the sound volume of activities. In the event of a Guest violating this provision, Umami Mountain Retreat shall be entitled to immediately remove the Guest and terminate the use of the premises. In such a case no refund will be provided.

Please also note the following general considerations and rules:

​

  • Retreat guests will be expected to pay for any damages to the property, venues, furniture, furnishings, and equipment beyond normal wear and tear.

  • Guests agree to comply with the Umami Mountain Retreat guide rules received and posted.

  • Guests will be expected to leave the property, including buildings, individual rooms, common areas, and meeting places in a clean and neat condition. Guests and groups shall be responsible for any undue and/or unreasonable cleaning due to excessive wear and tear and/or filth.

  • None of the following are allowed on the property: pets (unless arranged), illegal drugs, alcohol (without prior consent), firearms, dangerous weapons or knives, or fireworks.

  • Since Umami is surrounded by woods, mountains and borders a national park, the whole Umami Mountain Retreat area is a strictly non-smoking property. Guests violating this policy will be liable for all damages caused and will be asked to leave the premises without the option for a refund.  

 

5. Coordinator / facilitator retreat requirements

​

  • Following the initial event inquiry, the Guest Group coordinator has the opportunity to visit the property at no cost, or as organised with your hosts / Umami.

  • The retreat coordinator or facilitator must provide Umami Mountain Retreat with a comprehensive Retreat Program/itinerary no later than 7 days prior to arrival.

  • The number of guests attending the retreat needs to be confirmed no later than 7 days prior to arrival and commencement of the retreat.

  • Housing placement needs to be completed on Retreat Guru, 7 days prior to arrival. Umami reserves the right to alter guest lodging if needed.

  • The coordinator must provide all the retreat guest attendees with Indemnity Forms, Forms need to be returned back to Umami 3 days prior to arrival via email or given on the day of arrival.

  • The coordinator agrees to pay a breakage deposit of R1000 per day (or as specified) which will be refunded within 14 days after departure.

 

6.         Guest Privacy policy

​

Umami Mountain Retreat shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 7. Payment and security

​

Payment may be made via Visa, MasterCard or by bank transfer into the Umami bank account, the details of which will be provided on request.

7.1 Additional payment

​

Should there be additional last-minute overnight and/or day use guests added after the balance for the retreat has been paid, the invoice will be adjusted. Last minute overnight fee will be confirmed with the retreat facilitator.

​

7.2 Card acquiring and security

​

Card transactions will be acquired for Umami Mountain Retreat via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

7.3 Customer details separate from card details

​

Customer details will be stored by Umami Mountain Retreat separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.

7.4 Merchant Outlet country and transaction currency

​

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

​

7.5 Responsibility

​

Umami Mountain Retreat takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

​

7.6 Country of domicile

​

This website is governed by the laws of South Africa and Umami Mountain Retreat chooses as for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

​

7.7 Variation

​

Umami Mountain Retreat may, in its sole discretion, change this agreement or any part thereof at any time without notice.

 

8. Force Majeure

​

If Umami Mountain Retreat booking agreement is materially hampered, interrupted, or interfered with for reasons including, but not limited to: fire, casualty, lockout, strike labour conditions, unavoidable accident, riot, war, earthquake, landslides, pandemics, outbreaks, or any other acts of God, or by enactment, issuance or operation of any Municipal, Provincial or National law, ordinance or executive, administrative or judicial regulation, order this agreement and will not be responsible for payment of services not yet rendered. Additionally, guests will be refunded when cancellation from Umami accrues and all payments prior to the Force Majeure event will be refunded.

 

9. Indemnity and Hold Harmless

Retreat Guest, Event Host, Facilitator, Teacher, or Organiser agrees that they will not hold or attempt to hold Umami Mountain Retreat Venture LLC, its agents, teachers, host, facilitators, owners, members, or its employees liable for any loss, damage, injury to persons or property caused by any negligent act of any person on or about the property or caused in any matter other than intentional actions of Umami Mountain Retreat Venture LLC, its agents, owners, members and/or employees and will indemnify and hold Umami Mountain Retreat Venture LLC and its agents, owners, members and/or employees harmless from any liability for damages or claims against Umami Mountain Retreat Venture LLC arising out of or in any way relating to any such loss, damage or injury.

 

10. Dispute Resolution

​

All disputes shall first be resolved by mediation. In the event that the parties are unable to resolve the matter, they agree that the prevailing party shall be entitled to an award of the Attorney's fee and costs.

​

11. Right of Admission Reserved

​

Umami may exclude whoever they wish from their property, for whatever reason, because they have a right to their property as well as freedom of association. Retreat Guests under the age of 18 will not be allowed without prior consent.
